The authors carried out empirical research on how prosecutors and defense attorneys at the ICTY strategize in their use of historical evidence in the Trial Chamber, and what expert witnesses called by prosecution or defense hope to convey in their oral testimonies or written reports. This is the lacuna in the literature that the research seeks to fill.
By surveying key actors in cases at the ICTY, such as former Tribunal staff and defense team members, the authors draw a very interesting insight of what can be comprised as an integral part of the appraisal of the ICTY’s work.
